Legal Alert: 4th Circuit Enforces Defendant’s Stipulation in Subsequent Trial
POSTED JUNE 20, 2023
ABOUT THIS ALERT
Defendants should take caution when entering into trial stipulations, particularly where the stipulation might be used against them in a later trial. The 4th Circuit’s recent decision in U.S. v. Robertson emphasized the need for defendants to expressly limit stipulations to a single trial or risk having those stipulations enforced in later trials.
